Slip And Fall

SIip And Fall Injury Attorney In New Orleans: How Dangerous Property Conditions Lead To Injuries

Slip and Fall

As New Orleans Slip and Fall Attorneys, we see many area residents injured when they slip and fall while on property owned or operated by another individual or business. Most of the calls we get are about slip and falls in Walmart, Rouses Market, Winn-Dixie, Fresh Market, Whole Foods, Robert Fresh Market, Costco, a New Orleans Hotel, or a New Orleans casino.

Cases in which property owners are found liable for injuries sustained on their property, like a slip and fall or from another dangerous condition, are commonly known as “premises liability” cases.

These types of cases include:

  • slip and falling cases
  • inadequate maintenance
  • defective or dangerous conditions
  • inadequate building security leading to injury & assault
  • elevator accidents
  • dog bites
  • swimming pool accidents
  • escalator accidents
  • fires
  • amusement park accidents
  • water leaks or flooding
  • toxic fumes or chemicals

My name is Louis Gertler. I am a New Orleans Slip and Fall Attorney & premises liability lawyer, and a partner with the Gertler Law Firm.

I’d like to tell you a short story of one premises liability case I handled in the recent past – and the result at trial for this incident.

I first met S.L. (to protect this person’s identity I’ll use her initials) after she was referred by one of our law firm’s administrative assistants.

S.L. was visiting the Jefferson Performing Arts Center with her daughter’s middle school class to see a performance of Peter Pan. During the performance, she went into the lobby to use the restroom. Upon returning to her seat in the darkened auditorium, she struck her leg on a protruding part of stage equipment stored near the rear aisle.

The injury to her leg was significant and caused an infected abscess that required surgery to drain. She had severe pain for over a year, had difficulty standing for prolonged periods of time, and the injury left a disfiguring scar.

At our first meeting, S.L. was very nervous. After all, like most people, she had never had to contact an attorney for an injury like this, and she was unsure of what to do next.

S.L. had missed a significant amount of work before and after the surgery, which reduced her yearly income quite a bit. And the injury negatively affected her marital relations as well.

Other Slip and Fall Injury Information

Because of the many problems the injury caused, I filed suit on behalf of S.L. against the operator of the theatre who had negligently left the piece of sound equipment in the dark aisle.

We faced a number of setbacks but I was convinced that S.L. had a solid case.

I argued S.L.’s case all the way to the Louisiana Supreme Court, where the court unanimously found that the theatre operator was mostly at fault for her accident. In addition, S.L. received significant damages for her injury.

In recent years, we’ve helped numerous individuals pursue in-store accident premise liability claims after being injured on private property.
